1. Copyright and Usage Rights
- All photographs and videos taken by Kat De Laet Photography are copyrighted works and remain the intellectual property of the photographer.
- Photos and videos may be published on Kat De Laet Photography’s website, blog, social media accounts, and marketing materials.
- If you do not wish to have your photos published, you must inform the photographer in writing before the session.
2. Booking, Deposits, and Rescheduling
- A non-refundable deposit is required to confirm your session. The session is not considered booked until the deposit has been received.
- Clients are allowed one reschedule with at least 24 hours’ notice at no extra charge. Additional reschedules may be subject to a fee.
- In case of extreme weather conditions or emergencies, the photographer reserves the right to reschedule the session at no additional charge.
3. Session Conduct and Cancellation
- The photographer reserves the right to cancel the session if the client fails to meet the agreed-upon preparations or engages in inappropriate behavior.
- Clients should arrive on time and be fully prepared. Late arrivals may result in a shorter session without a refund.
- Any additional time beyond the booked session may be charged at the photographer’s discretion.
4. Pricing and Payment
- All prices are subject to change without notice. However, the price quoted at the time of booking will be honored.
- Payments must be completed before receiving final images. Payment plans are available for larger orders but must be agreed upon in writing.
- Sales tax will be applied where required by California state law.
5. Artistic Style and Image Delivery
- Kat De Laet Photography provides an artistic service, and the editing style is determined solely by the photographer.
- The photographer selects and edits the best images from the session. Unedited RAW images will not be provided under any circumstances.
- Clients will receive digital photos in .JPG format. Photos may not be cropped, edited, altered, or have filters applied by the client.
- The number of final images provided varies based on session duration and other factors.
6. Social Media and Watermark Usage
- Clients will receive both high-resolution and low-resolution images.
- Low-resolution images with watermarks are intended for social media sharing and must not be cropped or altered.
- High-resolution images (without watermarks) are for personal use only and may not be posted on social mediawithout permission.
7. Commercial Use and Copyright Infringement
- Clients purchase a personal-use license to print and share photos privately.
- Commercial use (e.g., advertising, branding, or reselling) is strictly prohibited without a separate licensing agreement and appropriate compensation for the photographer.
- Unauthorized commercial use will result in legal action in accordance with California copyright law.
8. Product Orders and Delivery
- Orders can only be placed through in-person sales or email communication after the session.
- All product orders are binding and non-refundable once placed. Editing and processing will commence only after full payment is received.
- When shipping products, Kat De Laet Photography is not responsible for damages caused during delivery.
9. Graphic Design and Prints
- Graphic designs (e.g., custom albums, cards, wall art) must be paid for in full before production.
- The design files remain the property of Kat De Laet Photography and will not be released to the client.
- All printed products must be ordered through Kat De Laet Photography to ensure quality and consistency.
10. Liability and Force Majeure
- Kat De Laet Photography is not liable for loss of images due to unforeseen circumstances (e.g., equipment failure, natural disasters).
- In the rare event of photographer cancellation due to an emergency, the session will be rescheduled or a refund will be issued at the photographer’s discretion.
11. Agreement to Terms
- By booking a session, the client agrees to all terms and conditions stated above.
- These terms are governed by the laws of the State of California, and any disputes will be resolved in a California court of law.
